Whistleblowing

What is whistleblowing?
Whistleblowing is the process through which individuals who become aware of criminal offences, breaches of laws and regulations, or fraudulent activities in a work-related context voluntarily report them, bringing them to the attention of the organisation concerned or the public.

Who are whistleblowers?
Whistleblowers are individuals who report unlawful conduct or irregularities they have become aware of in the workplace. In most cases, they are employees of public bodies or private companies, but the relationship may be less direct: former employees, consultants, volunteers, suppliers, customers, shareholders, stakeholders and anyone who has had contact with the organisation, even temporarily, may act as a whistleblower and benefit from the protections provided by law.

Exposing illegal activities may put whistleblowers at real risk of retaliation and, in the most serious cases, endanger their safety. For this reason, whistleblowers are protected by law, and Toscano Collezioni Srl is committed to safeguarding their identity by ensuring that neither their identity nor the contents of their reports are disclosed. To this end, Toscano Collezioni Srl has implemented a system for managing, reviewing and processing reports in compliance with Italian Legislative Decree No. 24 of 10 March 2023, implementing Directive (EU) 2019/1937, and applicable privacy legislation. The company also provides a range of secure reporting channels that whistleblowers can use.

What can be reported through whistleblowing?
As mentioned above, whistleblowers report unlawful conduct that harms the public interest and/or the organisation.

Examples include:
– violations of environmental protection regulations
– cases of corruption and financial scandals
– non-transparent recruitment practices and nepotism
– theft of company-owned goods

Personal complaints or grievances, as well as issues involving colleagues or supervisors, do not fall within the scope of whistleblowing. These are generally handled through different procedures, such as reporting to the Human Resources department.

What happens after a report is submitted?
All reports submitted under Italian Legislative Decree No. 24 of 10 March 2023, implementing Directive (EU) 2019/1937, will be acknowledged within seven days of receipt. For reports submitted openly, rather than anonymously, Toscano Collezioni Srl will confirm receipt and ensure the strictest confidentiality regarding the whistleblower’s identity and the subject matter of the report.

Regardless of the reporting channel used or whether a report is anonymous or identified, the appointed supervisory committee will initiate an investigation and review process. This process will be completed within a maximum period of three months.
At the end of the investigation, the supervisory committee will inform the whistleblower, where identifiable, of the outcome and any subsequent measures taken, while ensuring the strictest confidentiality regarding the whistleblower’s identity.

Should you require any further information or assistance, we remain at your disposal.
