What is whistleblowing?
Whistleblowing, an English term generally translated into Italian as “segnalazione di illeciti,” is the process by which individuals who become aware of crimes, violations of laws and regulations, or fraudulent activities in a work context voluntarily report them, bringing them to the attention of the organization itself or the public.
Who are whistleblowers?
Whistleblowers, or “segnalanti,” are individuals who report illegal or irregular conduct they have encountered in the workplace. In most cases, these are employees of public institutions or private companies, but the connection can be less direct: former employees, consultants, volunteers, suppliers, clients, shareholders, stakeholders, or anyone who has come into contact, even temporarily, with the organization can become a whistleblower and benefit from the legal protections in place.
Bringing illegal activities to light may expose whistleblowers to real risks of retaliation, and in severe cases, may endanger their personal safety. For this reason, whistleblowers are legally protected. Toscano Collezioni Srl is committed to safeguarding the identity of whistleblowers, not disclosing their identity or the contents of their report. In this regard, Toscano Collezioni Srl has implemented a system for managing, analyzing, and processing reports in compliance with Legislative Decree no. 24 of March 10, 2023, implementing EU Directive 2019/1937, and in accordance with current privacy regulations, including the provision of secure channels that whistleblowers can use.
What is the scope of whistleblowing?
As mentioned, whistleblowers report unlawful conduct that harms the public interest and/or the organization.
Some examples:
– Violations of environmental protection laws
– Cases of corruption and financial scandals
– Non-transparent hiring practices and nepotism
– Theft of company property
Complaints or claims of a personal nature, as well as disputes with colleagues or supervisors, are not considered whistleblowing and are usually addressed through different procedures, such as reporting to the Human Resources department.
What happens after a report is submitted?
All reports submitted under Legislative Decree no. 24 of March 10, 2023, implementing EU Directive 2019/1937, will be acknowledged within seven days of receipt. For non-anonymous reports, Toscano Collezioni Srl will confirm receipt, ensuring the highest level of confidentiality regarding the whistleblower’s identity and the subject of the report.
For all reports, regardless of the submission channel or whether they are anonymous or not, the designated control committee will initiate an investigation and analysis, which will be concluded within a maximum period of three months. At the end of the investigation, the control committee will inform the whistleblower (if non-anonymous) of the outcome and any resulting actions, while maintaining strict confidentiality of the whistleblower’s identity.
